Unfiled Tax Returns, Explained

If you have missing tax returns, the IRS may file a substitute return for you that leaves out deductions and credits. With your authorization we get your IRS records to see what's missing, prepare the returns and file them. Then we explain your options for any balance due. Depending on the situation and the filing platform, we can go back up to 7 years.

Your Questions, Answered

Quick answers about unfiled tax returns.

How many years of returns do I need to file?

The IRS generally expects the last six years to be filed to be in good standing, but every case is different.

What if I don't have my W-2s or 1099s?

With your written authorization we can get your wage and income transcripts from the IRS.

Will I owe penalties?

Possibly, but filing now limits them, and penalty relief may be available.

Can I go to jail for not filing?

Criminal cases are rare and usually involve deliberate fraud. For most people, filing voluntarily before the IRS acts is the best way to keep it a civil matter.

What if I'm owed refunds for some years?

File as soon as possible. Refunds are generally lost after three years, so older refunds may no longer be available, but recent ones can be.

Can the IRS's substitute return be replaced?

Yes. Filing your own return with your real deductions and credits usually lowers the amount the IRS calculated.
